38th day of trial against the 6 accused anti-fascists in the Düsseldorf Higher Regional Court

The interrogation of Mr. Neugebauer, who has now been promoted to chief detective at the LKA Saxony, began as a farce because he refused to give his first name. The chairman of the Senate let him get away with it, even though he could not prove that there was a specific threat. Ultimately, Neugebauer talked a lot about what he had done without being able to contribute anything to the clarification. He spent months watching videos of three crime scenes in Budapest to see if anyone could be recognized in them. He was able to recognize elongated objects, but no specific execution of the crime. Only the escape videos were of better quality. He then produced a 79-page report as if he had to submit a scientific paper.

When asked by Clara's lawyer Matthias Wisbar, the officer let it slip that he had spoken to his colleague, who had testified as a witness in the trial the previous week, about not revealing his first name in court. He doesn't want to say what exactly was discussed. This is not covered by the permission to testify. Clara's lawyer points out in vain that there could have been an inadmissible agreement between the two witnesses; the presiding judge doesn't want to know anything about it.

The following are two applications for evidence from Emmi's defense in the Erfurt matter. It is requested that Dr. Heinrichs, prison doctor in Dinslaken, to be called as a witness. He examined Emmi in July in the Dinslaken prison because of a burn injury and also measured her. Emmi wasn't wearing shoes or headgear and lo and behold, her height was 1.73 m. That's what it says in black and white in the medical file. The requested collection of evidence is actually of considerable importance for the question of guilt because the measurement results differ significantly from the information provided by the expert Prof. Labudde and the police: namely by at least 6.63 cm.
On the last days of the trial, Emmi's defense repeatedly pointed out that her client should have been excluded from the outset as a suspect in the Erfurt case. But the Federal Prosecutor's Office styled her as the main accused when the indictment was read out in January before the Düsseldorf Higher Regional Court.

Emmi's defense also requests that Chief Detective Jünemann from the Jena Police Department be called as a witness. This is intended to show that Emmi's height was 1.73 m even during an ED treatment in March 2025. According to the police report, the person in the crime videos from the Thor Steinar store in Erfurt - Emmi according to the prosecution - was measured at 1.6781 m using the 3D measurement method. This is a blatant contradiction and we can be curious to see how the State Security Senate deals with this when assessing the evidence. The GBA does not want to comment on this yet.

This is followed by a request for evidence from Ercan Zünbül and Sebastian Scharmer, Moritz's defense attorneys. You request to view an Arte contribution from April 8, 2026. Under the title "RE: Hungary's agitation against anti-fascists" it reports, among other things, that Zoltan Moys, one of the main organizers of the "Day of Honor", is the son-in-law of the Deputy Speaker of Parliament, who was in office from 2006 until the end of the Orbán era in 2026, and that the Nazi meeting was subsidized by the Hungarian government with funds equivalent to 190,000 euros.

They also request that four articles be translated from Hungarian and read out at the main hearing. They are said to show that in 2023 a grant of 70 million Hungarian forints was awarded by the Fidez government to the organizers of the Nazi march. It also documents that Zoltan Moys is the founder of the “Protected Society” foundation, which in turn was founded by right-wing extremist actors and which has received operational support from the Fidez government since 2020. Zoltan Moys received the “Knight’s Cross of the Hungarian Order of Merit” from the Hungarian Ministry of the Interior in 2023. Moys, who has a criminal record in Germany for using the symbols of unconstitutional organizations, glorified Adolf Hitler in a series he produced for Hungarian television, which we do not want to reproduce in detail here.

Moritz Defense also applied for the official website of the “Day of Honor” “kitorestura.hu”. The images shown there make it clear which Nazi memorabilia were on display at the event sponsored by the Hungarian government to glorify National Socialism.

In their statements, all of the accused made reference to the so-called “Day of Honor”. This is not a costume party for neo-Nazis, but an international networking meeting of fascists that was financially and organizationally supported by Hungarian state authorities. The prosecution's claim that the accused acted "in rejection of the rule of law" is incorrect. This is not a question of legal justification, but rather the question of whether the accused can be accused of having damaged Hungary as a democratic constitutional state, which is grotesque in view of the facts mentioned above.

This is followed by a Senate resolution to read out the list of the distribution of tasks in the preparation of Prof Labudde's expert report and to read it out, as all those involved in the process have agreed. As well as another Senate resolution: The defense's request to summon the witness Tenner, an employee of Prof. Labudde, is rejected because the facts have already been proven (through the reading that has just taken place).

Now the second witness of the day, Ms. Eva K., a former student. She observed the attack on the two neo-Nazis Raßbach and Beuthe in Erfurt in January 2023. The chairman explained at the beginning that there were still two or three questions unanswered after their first questioning. With her help, a phantom image was created and the question arose as to whether she had ever seen the image from Emmi's children's ID card, which had been published in the BILD newspaper, before the phantom image was created? "No."
When asked whether she recognized anyone in the election picture, she answered ambiguously with "There was a picture." She wasn't 100 percent sure whether she recognized anyone, she explains. When the chairman reproaches her for being quoted as saying "I'm pretty sure" when she submitted her photo to the police, Emmi's lawyer Britta Eder intervenes. Her colleague, lawyer Nils Dietrich, asks whether she had occasionally read the Bild newspaper beforehand?
"No." She had not previously seen the picture presented to her by the police from the Bild newspaper.

There is said to have been a class chat at the time, asks Emmi's lawyer. “Was there any communication about the matter in there?” She answers the question in the affirmative, but denies the question as to whether articles were also posted there. Lawyer Britta Eder goes back to the image in question: “Were there other images that roughly matched this image (from the student ID card)?” She can only remember this picture.

When the defense attorney asked whether she still had any memories of it, she answered in the affirmative, but she could no longer remember the individual people.

Now the screens show various posts with translations into German from the three Polish Nazis (Rafal Robert Baran, Justyna Malgorzata Baran and Bartlomiej Fabian Maksymilian Wilk) as well as a Facebook post from the Polish Nazis with a Nazi poster and the inscription: “All-Polish Youth, National Initiative “Ruch Narodowy”, another Instagram post from the Polish Nazis from March 5, 2023 and another post with Bartlomiej Fabian Maksymilian Wilk and the Ruch Narodowy politician Michał Piotr Urbaniak Also two Senate resolutions that are not worth mentioning.

Before the session closes, there is an announcement from the Senate that is interesting for further scheduling, namely that the injured Nazi Tamas Liptak will be heard on October 13th. Since he has already failed to comply with the summons, contact will be made with the Hungarian authorities to ensure a video interrogation.
