First, Emmi's defense requested that lawyer Niessing be heard as a witness: The hearing would show that the signs of wear and tear on Adidas Samba sneakers were caused by normal wear and tear. That sounds banal, but it can be of crucial importance for the evidence in the Pestalozzistrasse Erfurt case against your client Emmi. According to Labudde, the suspect listed under UP1 with the blue jacket is probably the accused Emmi. In addition to Labudde's dubious report, this hypothesis is also based on a covert observation in Gera, bEmmi was wearing Adidas Samba sneakers, which show the same signs of wear on the right heel, like the Samba sneakers worn by UP1 when escaping Pestalozzistrasse.

The first witness was a 41-year-old man from Budapest. He had already testified at the trial against Maja in Budapest and against Hanna in Munich. He wanted to take a taxi home that evening. When he came out onto the street to see if his taxi was there yet, he saw two people being attacked by a group on the other side of the street. Although he perceived the man lying on the ground with his skull cap and bomber jacket as a right-wing skinhead, he followed an impulse and came over to help the two. At that moment the group of three to four attackers ran away. The injured man sat up and held his head. The witness got an idea of ​​the injuries and spoke to the two of them: The woman seemed distraught, had previously screamed for help, cried and motioned that she was unhurt. The man was bleeding from his head. The injury did not appear to be particularly serious to the witness; the injured person was definitely conscious. The witness smelled the unmistakable smell of pepper spray. When he had made sure that the two were okay and another witness called 911, an ambulance arrived two minutes later. Before he got into his taxi and drove away, he gave the injured man his business card.

Then the Senate really wanted to know how the witness knew that the two were right-wing extremists. He had sympathized with the “opposite side” since his childhood, was sensitive to it, but always tried to stay away from them. He saw from afar that the person was wearing a white skull and the symbol “SS Subculture”. He was very sure that he was conscious: “He was lying on the ground” and when he got to the opposite side of the street, the injured man sat up, held his head, cursed and calmed down his girlfriend, who kept writing. "I gave him a tissue and my business card. You wouldn't just leave an unconscious person alone." “Then how were you contacted in the first place?” a judge asked him. He replied promptly that the police had contacted him using the number on the business card. The representative of the Federal Prosecutor's Office would now like to have the injuries described in precise detail. Although he had no medical training, he saw that the injuries were not serious. In the photos of the victim that were later shown to him, it looked more serious than the situation itself. No wonder, after all, hematomas only developed later, he explained.

In the second part of the day we heard an expert report on the translation of the forensic medical report and the interrogation protocols from Hungarian, which the defense had requested. The expert pointed out numerous translation errors in the forensic report. For example, in the translation of the medical report the diagnosis is “bruises”. She had to correct that and noted it accordingly. In fact it should be called “bruises”. The witness is quickly released.

Then it was about the procedural consequences of the accused's statements on the murder accusation made by the Federal Prosecutor's Office: "We are now in the comfortable position that we can shorten the presentation of evidence," explains Chairman Bachler: "In this case, the Federal Court of Justice requires that a confession must be checked with due care to ensure that the statements correspond to the truth. We will put together the relevant documents. There are many pictures in there that we will look at and introduce in the self-reading process. That is expected to be introduced at the beginning of September. Then we will see light at the end of the tunnel.”

This is followed by a resolution by the Senate to read out the police interrogation protocol of the witness Fabian at the Budapest Police Headquarters. Everyone involved in the process agreed to this. The chairman reads. On page 4 of the minutes it says in part: "My partner and I were getting off the bus when people came running up from behind and started hitting us. My partner fell to the ground and was hit. There were other people on the street too, but they didn't care."

Now it actually gets amusing: “Take a look here,” explains the presiding judge and, with a grin, points to the 88 in the wreath of honor on a picture: “The date of birth can be found here.” (Laughter in the courtroom because most of those present are still remembering theStatement by the Nazi Dudog from the day beforeremember. He claimed there that he had used 88 because it was the date of birth of his illegitimate child.) “And lo and behold,” the presiding judge continues: “Here is also the SS skull and crossbones symbol that we saw in the photographs; it actually looks very similar to the picture here.”
